Agreeing to these terms

These terms apply to anyone who uses muniway.com, including the free ADA website checker. In these terms, "Muniway," "we" and "us" mean Muniway, and "the site" means muniway.com.

By using the site, you agree to these terms and to our privacy policy. If you don't agree, please don't use the site. If you use the site for your organization, you confirm that you can accept these terms on its behalf.

These terms cover the website only. When an organization hires Muniway, a separate written agreement covers that work. If that agreement and these terms conflict, the agreement controls.

Using the site

You may use the site for lawful purposes. Don't:

  • break the law or violate anyone's rights;
  • try to get into systems, accounts or data that aren't meant for you;
  • upload malware or interfere with how the site works;
  • copy the site in bulk with bots or scrapers, except search engines and other crawlers that follow our robots.txt file;
  • put false information in our forms, or send someone else's details without their permission.

Rules for the ADA website checker

The checker is free, and it fetches real pages from our servers. To keep it fair and safe:

  • Only check sites you own, manage or have permission to check.
  • Don't use it to overload, attack or test the security of any site.
  • Don't automate it, run checks in bulk or try to get around its limits.
  • Don't point it at private networks, internal addresses or pages behind a login.
  • Don't enter addresses that contain passwords, tokens or personal information.

We may limit, block or change the checker at any time.

What the checker's results mean

The checker runs automated tests on one page at a time. Automated tests catch only some accessibility issues. Many others need a person to review them, such as whether link text makes sense or captions are accurate.

Results are for information only. They aren't legal advice. They aren't an audit or a certification, and they don't show that a site meets the ADA, WCAG 2.1 AA or any other standard. A clean result doesn't mean a page has no problems.

Results can be wrong or incomplete, and the page you checked may change afterward. For questions about your legal obligations, talk to your attorney.

Our content

Muniway owns the content on this site, including its text, graphics, logo and code, or has permission to use it. You may view it, print it and share links to it. You may not copy, sell or republish it without our written permission, except as described here.

You may quote short passages from our blog if you credit Muniway and link to the original post.

Don't use the Muniway name or logo in a way that suggests we endorse you or your product.

If you send us ideas or feedback, we may use them without owing you anything.

The site links to websites we don't run, such as standards documents and government pages. We aren't responsible for their content or their privacy practices.

No warranties

We provide the site and the checker "as is" and "as available." To the fullest extent the law allows, we make no warranties of any kind, express or implied. That includes warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise that the site will always be available or free of errors.

Limits on our liability

To the fullest extent the law allows, Muniway isn't liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, that come from your use of the site or the checker. This applies even if we were told such damages were possible.

The site and the checker are free. Our total liability for any claim about them is limited to $100.

Some states don't allow some of these limits. Where that's the case, they apply only as far as the law allows.

Ending access

We may suspend or block access to the site or the checker for anyone who breaks these terms or misuses them, without notice. We may also change or stop any part of the site at any time.

Governing law

Michigan law governs these terms, without regard to its conflict-of-law rules. Any dispute about these terms or the site will be decided in the state or federal courts located in Michigan.

Changes to these terms

We may update these terms. The date at the top shows when they last changed. If you keep using the site after a change, you accept the new terms.

General

If part of these terms can't be enforced, the rest still applies. If we don't enforce a term right away, we can still enforce it later. These terms and our privacy policy are the whole agreement between you and Muniway about your use of the site.
